This table sets out the statutory authority for each of the Merit Protection Commissioner's functions.
For the Australian Public Service the relevant legislation is the Public Service Act 1999 and the Public Service Regulations 2023 (For applications received prior to 30 March 2023 see Public Service Regulations 1999).
For the Parliamentary Service the relevant legislation is the Parliamentary Service Act 1999 and the and the Parliamentary Service Determination 2013.

Section 33 of the Australian Federal Police Act 1979 and s 53 of the Australian Federal Police Regulations 2018 provide an entitlement for Australian Federal Police employees to seek review by the Merit Protection Commissioner of a decision of the Australian Federal Police Commissioner to retire them on invalidity grounds, if they do not consent to being retired.
