You are here Home Application for review of a workplace decision Application for review of a workplace decision Published 27 August 2021 Use this form to apply to directly to the Merit Protection Commissioner for: a review of a breach of the code of conduct decision a review of a sanction decision making a complaint about a decision on final entitlements after you have left the APS or Parliamentary Service. This form may also be used in certain limited circumstances, where it may not be appropriate to seek a primary review from your agency. These circumstances are: your agency head was directly involved in the action; or it is not appropriate, because of the seriousness or sensitivity of the action, for an agency or department head to deal with the application; or the action is claimed to be victimisation or harassment of the employee for having made a previous application for review of action. Before you submit your application on any of the three above grounds, check that you meet the requirements to apply directly to the MPC. You will need to lodge a separate form for each decision. You do not have to wait until a sanction is imposed to lodge the review of the Code of Conduct determination. Sanction decision You have 60 days to lodge a review of a Code of Conduct determination or sanction decision, from the date of the decision. You will need to lodge a separate form for each decision. You do not have to wait until a sanction is imposed to lodge the review of the Code of Conduct determination. You cannot lodge a sanction review application until the sanction decision is final. If you have only received a preliminary view, you will need to wait until the decision is finalised. If you receive a sanction of termination, we cannot review that decision, you may wish to contact the Fair Work Commission. Date of sanction decision What sanction was imposed? It is so serious or sensitive that I cannot lodge it with my agency. I was victimised because I lodged a review application previously.
